Howry Cow!
OK Cubs fans and offensive t-shirt haters, I may have the solution to the summer of our discontent caused by the Horry Kow shirts:
All design credit goes to our resident photoshop wizard, santoswoodenlegs.* Note that the shirt is not available for purchase. As of this writing there are exactly three (3) in existence - one for me, one for SWL and one for Mr. Howry, the latter of which SWL may use to bribe Howry into autographing SWL's shirt (and hopefully signing off on allowing us to use his image).
Before making this shirt generally available, I wanted to solicit the advice of BCB'ers regarding: (a) potential legal issues; (b) whether any of these would sell; and (c) if you know of a charity with which Mr. Howry is involved. I am not at all interested in making any money on these, and I figure that the charitable angle may alleviate the potential legal issues.

* SWL only made the artwork as a joke and was not aware that I may make it commercially available.

Legal Issues are...
1) You’ll have to check and see if Howry has any objection to using his picture and name.
2) Although I doubt it, you’ll have to check and see if anyone has copyrighted or trademarked that expression.
3) Assuming the phrase isn’t copyrighted or trademarked (once again, I doubt this) you may want to do it.
4) You should check with the Cubs to see if they hold some kind of exclusive right to using the Cub hat on the shirt.
I know I’m being overly cautious, but better to be cautious, then get burned later.
I don’t think I’d want this shirt. It’s too obscure here in Denver. I’d love to get a “Bleed Cubbie Blue” shirt, though I know it was a hassle last year for whomever shipped them.

I'm much more inclined...
...to buy three BCB shirts that actually say “Bleed Cubbie Blue” in one shape or form on them. One for me, a friend, and my father. I prefer something like this over “Howry Cow”; and to some degree, I still think it’s a pun on a racially-charged shirt. Not to the same degree, but still.

only your #2 is easy to check online using TESS - no mark appears to exist containing howry.
i hadn’t even really thought of the Cubs, but with the “C” on the hat they may very well have a say. does anyone have contact information for a decision-maker in legal or licensing or something for the Cubs?
As for Howry himself, hopefully SWL will get his permission when he presents him with his shirt!

My thoughts
Although it looks very goofy, the real humor involved is way too subtle. There are multiple layers of information and context that the viewer needs in advance in order to “get” this shirt. Very clever, but I can’t see it being too commercial.

the only people that would really “get” it would know about the horry kow shirt, which is a very small subset of the population but a relatively large subset of cubs fans and pretty much every BCB reader. that’s probably enough of a market to go to print – selling 100 shirts would make $500 for Howry’s charity (whatever that is . . . anyone? bueller?).

While perhaps not a legal issue...
...I would think you to have at least a moral obligation to get SWL’s permission to use the artwork design. This one’s pretty obvious, so I’m guessing you already have or else you wouldn’t have gone this far yet.
Still, the way the diary is written (especially the * disclaimer) leaves open the possibility that SWL has not signed off on the selling of the shirts, so if that’s the case, and if this effort goes farther, then I would hope SWL has a say in this.

Write Howry, c/o the Cubs
Tell him your story, ask him about a charity and then do it. This way you’re covered. If he’s for it and he can specify a charity and to boot – perhaps – match the monies received through purchases upto a certain point, you’ll not only have a chance to make a hit with him, you’d be covered.
On the subject matter question, yes I’d buy one. In fact, I’d get two…

i think you are right. i may wait to give SWL the chance to present a shirt to Howry at the Cubs/Padres series in San Diego. but i think a letter to the man himself c/o the cubs, maybe cc’ing Cubs general counsel Michael Lufrano (maybe it can turn into the sickest in-house job offer i can think of) would be the best course of action.

My personal opinion is....
the Cubs, MLB, and the MLBPA are gonna sink this ship before it even get’s out of drydock, irregardless of how Howry feels about it. I guess we’ll have to wait and see. I just hope he’s cool enough to accept the shirt I’m gonna offer him.

That question should be directed toward me...
and since I’m at work and I did that awful mess of a graphic at home…I have no idea. But I can tell you that it wasn’t a font that was “just right”. I found one that was close enough and then it got the living crap stretched and squeezed out of it in photoshop.
