Sources close to the family say that as the Ricketts went through their due diligence on the team they determined that the broadcast contracts contained provisions that limited their value to the team. The sources haven’t identified the sticking points. A spokesman for the Ricketts said the family wouldn’t comment on the negotiations. Tribune Co. also declined to comment.

Wouldn’t you think that someone who is presumably as savvy as Ricketts in business dealings would have figured this out before he put in a bid on the team?

Of course, you’re talking about dealing with Sam Zell, who bought a media company just at the time when traditional media (newspapers, in particular) were heading south.

This deal won’t be finished before the season ends.

That's a start however, the key is the back-end provision

Read the 3rd and 4th to the last paragraphs. It’s the key. I bold-faced the absolute biggest point here.

A potentially bigger issue might involve what are known as “back-end provisions.” These are contract terms that address what happens to the broadcast rights at the end of the agreement. For a team owner, the best terms would allow the team to take its games and shop them to the highest bidder when the contract expired. The station would prefer a right of first refusal or some other way to hold on to the games without getting into a bidding war.

“How the back-end provisions read is critical to whether there’s a big bump up in long-term revenue or not,” the banking source said.

Ricketts would want to have the control of how the team can auction-off the TV and radio rights. If they’re hooked into ‘GN (as much as many of us would want the Cubs to have all 162 games on ’GN) with ’GNs right of first refusal, it could put a serious limit on how much revenue can be generated by the Cubs’ broadcasts. Unfortunately its all about running a business.

Actually I do believe Ricketts did check this out before. He made a good-faith estimate in the media’s value when he placed his bid. But of course the key to the whole thing is still Zell. Think about when the team went on the block; April, 2007. No one knew the magnitude of what was going to happen but anyone in the business world knew what the housing market was going to do in general, and the banks followed that up with the mortgage mess. If Zell were not so greedy – and this was more than a year before we all first heard of Bear Stearns failure – the deal would have been done long ago. Financing for Ricketts would not have been at the stale-mate it has been and we’d be already more than a year into a new ownership.

The devil is always in the details and here we have many competing internal interests and corporate turfs. The end of contract provision is probably a key component for the those financing the deal for the Cubs have historically undervalued their broadcast rights gifting non market driven fees to WGN a form of Americanized Japanese business structure.

Here is the bigger issue for Zell and WGN, they got a deal, the deal must be worked out and Ricketts can walk away….Tribune essentially cannot….

It may have gone on the block in April 2007.

But Ricketts’ bid didn’t get formally announced until January 2009, after the current mess was already in high speed.

I agree, the right of first refusal will probably be a sticking point. We’re not going to have any closure on this till after this season ends, at the earliest.

Unfortunately

for us fans, this is is REALLY going to hamstring Jimmy Hendry in spending much if any money to pick up a key FA. People propose getting this guy – or that one – as if playing fantasy GM, but in reality, I am really of the opinion that at most Hendry would only be able to acquire a marginal-type player with an expiring contract. Trades, of course, are something else.

We don't know this for certain.

It may be that they’ve held back some money for a midseason acquisition, not wanting to blow it all before the end of May.

We’ll find out a month from now, if they need to. Remember, they WILL be getting a big bat after the All-Star break: Aramis Ramirez.

However – it still is going to take A-Ram a bit to get “in-synch” when he returns – AND, we just do not know what the return will look like.

To go several more months counting on career “scrappy” minor leaguers, and Ryan Freel/Aaron Miles, to deliver in the clutch is going to be dicey – without reinforcements – in order to stay in the hunt. Fonty did a nice job yesterday, however – and may the baseball gods allow him much of the same moving forward as he’s now our “semi-perm” 3B (according to Lou)

What???

Why do you always insist that there is more money to spend at every turn? You have no idea what is going on with the Cub payroll situation. The payroll can’t keep going up and up and up. It is $136 million with LOTS of ugly contracts already on the books.

we do have some really really bad contracts. We also have to many contracts with NTCs. I truly do think Jim Hendry is a horrible gm.

But one thing for sure, if this damned deal were done now, Hendry would know exactly what he can do and what he can’t do…before July 31st.

I know Ricketts didn’t get the bid nod until Jan, 2009. But Zell and TribCo took waaaaay too long to even get to that point. That is what I’m referencing. There’s no reason why it couldn’t have been done sooner. Yes, Ch-11 complicates things but it’s Zell doing the Ch-11, not some outside power. He knew exactly what he was doing at that time. Where I believe he failed was grossly underestimating the financial markets’ issues. Someone at his level I would think would have more understanding of the issues at hand.

"Handcuff Jim Hendry"?!?!?!?

Precisely how much payroll flexibility does Jim Hendry need to be afforded each season?!? For crying out loud the Cubs have a $136 million payroll already which is 3rd highest in baseball !!! Handcuff?!?!? That is something they say in places like Milwaukee or Houston where there is a legitimate salary cap so to speak. Hendry has been given wheelbarrows full of money to spend and has massively screwed it up on all levels.

Awww, come on guys, it's so simple maybe you need a refresher course. It's all ball bearings ...
